Terms of Service

1. Platform Nature & Scope

By using DrawMagic, you acknowledge and agree that:

• DrawMagic acts solely as an intermediary platform facilitating connections between service seekers (buyers) and service providers (builders, developers, interior designers, architects, contractors, and other professionals).
• All transactions, agreements, contracts, and services occur directly between the buyer and the service provider. DrawMagic is not a party to any such agreements.
• DrawMagic does not guarantee, warrant, or endorse any property listings, project details, pricing, timelines, quality of construction, or services offered by any provider on our platform.
• We are not responsible for verifying the accuracy, completeness, or truthfulness of any information provided by service providers, including but not limited to property specifications, RERA compliance claims, pricing, amenities, or delivery timelines.

2. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• DrawMagic, its directors, employees, affiliates, and partners shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
  • Any property purchase or transaction
  • Construction defects, delays, or quality issues
  • Financial losses from any investment decisions
  • Disputes between buyers and service providers
  • Fraudulent activities by any third party
  • Breach of contract by any service provider
  • Any services rendered or not rendered by providers
• DrawMagic expressly disclaims any and all liability for claims arising from use of our platform, including claims related to properties, services, or providers listed on the platform, regardless of whether such claims arise in contract, tort, negligence, strict liability, or any other legal theory.
• In no event shall DrawMagic's aggregate liability exceed ₹1,000 (One Thousand Indian Rupees) or the platform fees actually paid by you in the 12 months preceding the claim, whichever is lower.

3. User Due Diligence & Responsibility

Users are solely responsible for:

• Independent verification of all property details, RERA registrations, builder credentials, legal clearances, and documentation before making any purchase or payment.
• Conducting site visits to physically verify properties, construction progress, and amenities.
• Seeking legal counsel before signing any agreements or making payments to service providers.
• Verifying RERA compliance directly with the relevant state RERA authority.
• Financial due diligence including loan eligibility, tax implications, and payment schedules.

4. Service Provider (Builder/Provider) Terms

Service providers listed on DrawMagic agree that:

• They are solely responsible for the accuracy, legality, and compliance of all information provided on their listings.
• They hold all necessary licenses, registrations (including RERA where applicable), and legal permissions to offer their services.
• They will honor all commitments made to leads/buyers contacted through our platform.
• They indemnify DrawMagic against any claims arising from their services, products, or representations.
• DrawMagic reserves the right to remove, suspend, or ban any provider at our sole discretion for policy violations or user complaints.

5. Platform Quality & Onboarding

While we strive to maintain platform quality:

• We onboard service providers based on our internal quality policies, which may include verification of business registration, RERA compliance, and past project history.
• Onboarding does NOT constitute an endorsement, warranty, or guarantee of any provider's services, quality, or reliability.
• We may remove providers who violate our policies or receive sustained negative feedback, but this is at our discretion.
• User ratings and reviews reflect individual experiences and are not verified for accuracy by DrawMagic.

6. No Investment or Legal Advice

DrawMagic does NOT provide:

• Investment advice or recommendations
• Legal advice or opinions
• Financial planning or loan advice
• Property valuation services
• Construction consulting or supervision

Any information, estimates, or suggestions on our platform (including AI-generated content) are for informational purposes only and should not be relied upon for making financial or legal decisions.

7. Content & Moderation

Users agree not to:

• Upload false, misleading, or fraudulent information
• Post inappropriate, offensive, or illegal content
• Attempt to circumvent our security or moderation systems
• Harass other users or service providers
• Use the platform for any illegal purposes

We reserve the right to remove content, suspend accounts, and take legal action against users who violate these terms.

8. Dispute Resolution

For disputes between buyers and service providers:

• DrawMagic may facilitate communication but is NOT obligated to mediate or resolve disputes.
• Users should seek resolution directly with the service provider or through appropriate legal channels.
• For real estate disputes, users should approach the relevant RERA authority or consumer forum.

Disputes with DrawMagic shall be governed by the laws of India and subject to the exclusive jurisdiction of courts in Hyderabad, Telangana.
